Court of Appeal partially overturns verdict in Leventis Gallery accident case
The Cyprus Court of Appeal has partially overturned a ruling regarding an occupational accident at the Leventis Gallery in Nicosia that occurred in 2015.
The incident took place on March 16, 2015, when part of a suspended ceiling collapsed and injured an employee, causing her serious shoulder and neck injuries. Previously, the gallery's foundation and its director had been found guilty on six counts related to health and safety violations and were fined.
The Court of Appeal concluded that the lower court had erred in its assessment of the evidence and overturned some of the charges related to ensuring safety in the workplace. The court indicated that there was insufficient evidence that the management could have foreseen the collapse or failed to take reasonable safety measures.
At the same time, the court upheld certain charges, specifically those related to altering the scene of the accident after the incident and failing to notify the authorities in a timely manner.
As a result, some of the fines were canceled, while specific convictions regarding procedural violations following the accident remain in force.
